1. THE PRESIDENT: I give permission to appeal and order utmost expedition. Time estimate of one hour. I will just stay the contact other than at the contact centre hearing the appeal.
2. My reason for giving permission to appeal is that it is, in my view, arguable that HHJ Anwyl, having come to the conclusion in October that there could be contact only under independent supervision at a contact centre especially arranged for supervised contact, and that the recorder, Recorder Ball, not only changed the contact over Christmas, because there was to be no contact otherwise since the contact centre was closed, but has continued that contact with the uncle and aunt to run until the end of February.
3. Whether the contact was right or not over Christmas is water under the bridge, but whether it should continue is a question of how important the risk is in the light of the mother's possible prosecution for attempted murder of the child.
4. We will try and fit this in for next week at 10am.
ORDER: Permission to appeal granted. Order for utmost expedition. Costs in the appeal.
