  1. In this matter, for reasons set out in written judgments which have been available to the parties and are now available generally, the appeal is dismissed. The parties have agreed that the appellant should pay the respondent's costs of the appeal on the standard basis, to be subject to detailed assessment if not agreed, and they have also agreed that the appellant is to pay £5,000 to the respondents on account of those costs by 4.30 on 25 May.
