Justices’ Reasons

 

 

 

 

1.

We have heard an application by the Local Authority that E is made the subject of a Residence order to C and D and that the proceedings concerning F be adjourned to a CMC and he be the subject of an Interim Care order.

 

2.

Proceedings began in May 2010 when the Local Authority’s concerns were generally based upon the domestic violence.   E had been residing with his grandparents C and D for over 2 years.   The court on the 21 May made an Interim Care Order in respect of F and a Residence Order for the interim period for E.

 

3.

All parties including the children’s Guardian agree that making a Residence Order is in E’s best interest.

 

4.

We have considered the Welfare checklist.

 

5.

We agree that making a Residence Order for E is necessary and in the best interest of E to formalise the Grandparents position, give them Parental Responsibility, and prevent any change which would disrupt his future.

 

6.

We therefore make E the subject of a Residence Order in favour of C and D.

 

7.

We adjourn the CMC concerning F until the 13 August 2010 and renew the Interim Care Order until that date.
