    JUDGMENT OF MR JUSTICE FRANCIS D MURPHY DELIVERED THE 5TH DAY OF JULY, 2001.
    The appeal in this matter arises out of the same incident and has the same history and virtually identical facts with those considered in the case of Anthony McNamara .v. Judge Uinsin MacGruairc in which judgment has just been delivered. Indeed all four cases were heard together.
    In the circumstances it is unnecessary to analyse further the facts of the matter or the legal principles applicable. I would dismiss the appeal for the reasons given in the McNamara case.
