EXCHEQUER CONTRIBUTION ORDER, 1927.

EXCHEQUER CONTRIBUTION ORDER, 1927.

WHEREAS, by Section 9 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), it is enacted that wherever under any British Statute any grant, whether annual or capital, is directed to be made by the Treasury out of the Consolidated Fund, or by the Treasury or any other Government Department out of any other Fund, and the amount of such grant is by such Statute fixed either for the whole of the late United Kingdom or for any part thereof which included the area now comprised in Saorstát Eireann, the Minister for Finance may by Order apportion such amount between Saorstát Eireann and the rest of the area in respect of which such amount is fixed as aforesaid, and may by such Order fix the amount of such grant to be made under such Statute in Saorstát Eireann.

AND WHEREAS, by Sub-section (1) of Section 5 of the British Statute entitled The Purchase of Land (Ireland) Act, 1891, it is enacted that there should be established a Guarantee Fund consisting of a cash portion and a contingent portion, and that in every financial year there should be paid to such Guarantee Fund in respect of the cash portion thereof out of the Consolidated Fund a sum of £40,000 (in that Act and in this Order referred to as the Exchequer Contribution).

AND WHEREAS, by Sub-section (1) of Section 13 of the British Statute entitled the Labourers (Ireland) Act, 1906, it is enacted that the annual sum of £6,000, forming portion of the residue of the Exchequer contribution under the said Purchase of Land (Ireland) Act, 1891, should be placed at the disposal of the Local Government Board for the purpose of the Labourers Acts.

AND WHEREAS the amount of the Exchequer contribution and the amount of the residue thereof placed at the disposal of the Local Government Board as aforesaid, were fixed by the British Statutes aforesaid for the whole of Ireland, being a part of the late United Kingdom which included the area now comprised in Saorstát Eireann, and it is necessary that such amounts should be apportioned between Saorstát Eireann and the rest of the area in respect of which such amounts were fixed as aforesaid, and that the respective amounts of the Exchequer contribution and of the residue thereof placed at the disposal of the Local Government Board as aforesaid to be paid under the Statutes aforesaid in Saorstát Eireann should be fixed.

AND WHEREAS the functions of the Local Government Board under or in relation to the Labourers Acts are now vested in the Minister for Local Government and Public Health.

NOW the Minister for Finance, in exercise and by virtue of the power in this behalf vested in him by Section 9 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and of every and any other power him in this behalf enabling, hereby Orders as follows :—

1. This Order may for all purposes be cited as the Exchequer Contribution Order, 1927.

2. The annual sum of £40,000 fixed by Sub-section (1) of Section 5 of the Purchase of Land (Ireland) Act, 1891, as the Exchequer contribution to the cash portion of the Guarantee Fund established by that Section is hereby apportioned between Saorstát Eireann and the rest of the area in respect of which the said sum was fixed by the said Act as follows, that is to say :—

(a) In respect of Saorstát Eireann, the sum of £36,153 12s. 5d. (Thirty-six thousand, one hundred and fifty-three pounds, twelve shillings and five pence) ; and

(b) In respect of the rest of the area aforesaid, the sum of £3,846 7s. 7d. (Three thousand, eight hundred and forty-six pounds, seven shillings and seven pence).

3. The annual sum of £6,000 fixed by Sub-section (1) of Section 13 of the Labourers (Ireland) Act, 1906, as the portion of the residue of the Exchequer contribution to be placed at the disposal of the Local Government Board for the purpose of the Labourers Acts is hereby apportioned between Saorstát Eireann and the rest of the area in respect of which the said sum was fixed by the said Act as follows, that is to say :—

(a) In respect of Saorstát Eireann, the sum of £4,901 11s. 6d. (Four thousand, nine hundred and one pounds, eleven shillings and six pence) ; and

(b) In respect of the rest of the area aforesaid, the sum of £1,098 8s. 6d. (One thousand and ninety-eight pounds, eight shillings and six pence).

4. The amount of the Exchequer contribution to be paid in Saorstát Eireann out of the Central Fund under the said Sub-section (1) of Section 5 of the Purchase of Land (Ireland) Act, 1891, to the cash portion of the Guarantee Fund established by that Section shall be the sum of £36,153 12s. 5d. (Thirty-six thousand, one hundred and fifty-three pounds, twelve shillings and five pence).

5. The amount of the annual sum to be placed at the disposal of the Minister for Local Government and Public Health for the purposes of the Labourers Acts in Saorstát Eireann under Sub-section (1) of Section 13 of the Labourers (Ireland) Act, 1906, out of the residue of the Exchequer contribution shall be the sum of £4,901 11s. 6d. (Four thousand, nine hundred and one pounds, eleven shillings and six pence).

6. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924.
