AIR NAVIGATION (INVESTIGATION OF ACCIDENTS) REGULATIONS, 1928 (AMENDMENT) REGULATIONS, 1943.

AIR NAVIGATION (INVESTIGATION OF ACCIDENTS) REGULATIONS, 1928 (AMENDMENT) REGULATIONS, 1943.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 60 of the Air Navigation and Transport Act, 1936 (No. 40 of 1936), (as adapted in consequence of the enactment of the Constitution), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations—

1. These Regulations may be cited as the Air Navigation (Investigation of Accidents) Regulations, 1928 (Amendment) Regulations, 1943.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The Air Navigation (Investigation of Accidents) Regulations, 1928 ( S. R. & O. No. 21 of 1928 ), are hereby amended in the following respects—

(a) by the deletion of subparagraph (ii) of paragraph (3) of regulation 5 and the substitution therefor of the following subparagraph—

" (ii) the breaking of a main spar or part of a wing of prime importance to its structural strength ; or ",

(b) by the insertion in regulation 7 of the following new paragraph—

" (1A) The Minister may appoint one or more persons, being wireless telegraphy, meteorological or other experts, to act as technical advisers to an Inspector of Accidents during the holding of a preliminary investigation and may direct that the technical advisers shall receive such remuneration (if any) as the Minister, with the approval of the Minister for Finance, may determine.",

(c) by the deletion of paragraph (a) of regulation 8 and the substitution therefor of the following paragraph—

" (a) By summons under his hand, to require the attendance of all such persons as he thinks fit to call before him and examine for the purpose of his report, and to require answers or returns to any inquiries he thinks fit to make."
