NATIONAL HEALTH INSURANCE (UNCLAIMED PROCEEDS OF STAMP SALES) REGULATIONS, 1946.

NATIONAL HEALTH INSURANCE (UNCLAIMED PROCEEDS OF STAMP SALES) REGULATIONS, 1946.

FRANCIS CONSTANTINE WARD, Parliamentary Secretary to the Minister for Local Government and Public Health, in exercise of the powers vested in the said Minister by the National Health Insurance Acts, 1911 to 1942, and by virtue of the Local Government and Public Health (Delegation of Ministerial Functions) Order, 1945, by this his Order makes the following Regulations, that is to say :—

1. These Regulations may be cited as the National Health Insurance (Unclaimed Proceeds of Stamp Sales) Regulations, 1946.

2. In these Regulations—

the expression " the Minister " means the Minister for Local Government and Public Health,

the expression " the Society " means Cumann an Árachais Náisiúnta ar Shláinte.

the expression " the principal Act " means the National Insurance Act, 1911.

3. The residue of any sums received by the Minister on account of sales of stamps issued for the purpose of Part I of the principal Act and available for application under Section 29 of the National Health Insurance Act, 1918, as amended, shall be applied to the extent required in repaying to the Society,

(a) the sum of seventy-three pounds seven shillings and ten pence (£73. 7s. 10d.) in respect of the costs of legal proceedings arising out of an appeal under Section 67 of the principal Act, as amended, awarded against the Society by the High Court of Justice on the 24th day of March, 1944 :

(b) the sum of thirty-five pounds two shillings and fourpence (£35. 2s. 4d.) in respect of the expenditure incurred by the Society in defending such proceedings ; and

(c) the sum of four thousand four hundred and eighty-nine pounds (£4,489) in respect of the cost of the Society of establishing to the satisfaction of the Minister a register of insured persons for the purposes of the actuarial review and report on the finances of the National Health Insurance system pursuant to Section 2 of the National Health Insurance Act, 1942 .
