DEPARTMENT OF LOCAL GOVERNMENT. COUNTY MANAGEMENT ACT, 1940. COUNTY MANAGEMENT (RESERVED FUNCTIONS) ORDER, 1948.

DEPARTMENT OF LOCAL GOVERNMENT. COUNTY MANAGEMENT ACT, 1940. COUNTY MANAGEMENT (RESERVED FUNCTIONS) ORDER, 1948.

The Minister for Local Government in exercise of the powers vested in him by subsection (3) of Section 16 of the County Management Act, 1940 , hereby directs and orders as follows :--

1. The powers, functions and duties of every Council of a County and of every elective body in relation to each of the matters specified in the Schedule to this Order shall be exercised and performed directly by such Council or body.

2. This Order may be cited as the County Management (Reserved Functions) Order, 1948.

SCHEDULE.

Matters in relation to which the powers, functions and duties of Councils of Counties and of elective bodies are to be exercised and performed directly by such councils and bodies.

The alteration and fixing, under Section 10 of the Local Government Board (Ireland) Act, 1872, of dates for holding fairs.

The power under Section 103 of the Public Health (Ireland) Act, 1878, to do any of the things relating to markets specified in the said section.

The assistance of students at universities and the placing of sums at the disposal of any university or college thereof under Section 10 of the Irish Universities Act, 1908.

The granting and transfer of licences under Section 2 of the Cinematograph Act, 1909.

The making of an application for an Order under Section 74 of the Local Government Act, 1925 (No. 5 of 1925).

The making of regulations under Section 28 of the County Management Act, 1940 (No. 12 of 1940) prescribing the procedure to be followed in regard to the reception and examination of tenders.

The making of a preliminary order under Section 3 of the Acquisition of Derelict Sites Act, 1940 (No. 29 of 1940).

The making of a proposal under the Water Supplies Act, 1942 (No. 1 of 1942) to take a supply of water from a source of water.

The authorisation of a person to attend any conference or meeting of members of local authorities held for the purpose of discussing any matter which is connected with the duties which devolve on them.

The provision of and contribution towards the expenses of a band to give public performances of music under Section 75 of the Local Government Act, 1946 (No. 24 of 1946).

The making of an order under Section 31 of the Local Government (Sanitary Services) Act, 1948 , prohibiting the erection or retention of temporary dwellings on land or water.
