I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance) Act, 1947 (No. 39 of 1947)) and of every and any other power me in this behalf enabling, hereby order as follows :--

1.--(1) This Order may be cited as the Onions (Maximum Prices) (No. 3) Order, 1948.

(2) This Order shall come into operation on the 4th day of September, 1948.

2. References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3. In this Order--

(a) the word " onions " includes

(i) potato onions and shallots intended otherwise than for planting ;

(ii) onions which have been preserved by cold storage or by any other method of storage but does not include onions which have been canned or bottled or preserved otherwise than aforesaid ;

(b) any fraction of a halfpenny shall be regarded as one halfpenny.

4. No person shall sell onions at a price exceeding a price calculated at whichever of the following rates is appropriate, that is to say :--

(a) When sold to a retail merchant--28/- per cwt. free on rail.

(b) When sold by retail--4d. per lb.

5.--(1) Where onions are delivered to the premises of a retail merchant, the maximum addition that may be made to the price calculated in accordance with Article 4 (a) of this Order in respect of such delivery shall be an amount not exceeding the lowest cost of delivery of such onions by public transport from the railway station nearest to the premises of the vendor to the premises of the retail merchant.

(2) Whenever a person sells onions to a retail merchant, such person shall, on the demand in writing of the purchaser, deliver to such purchaser a statement in writing setting out the amount of the price which is referable to the cost of transport mentioned at Article 5 (1) of this Order.

6. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular onions or description of onions the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction.

7. The Onions (Maximum Prices) (No. 2) Order, 1948 ( S.I. No. 194 of 1948 ) is hereby revoked.
