DUBLIN TRAFFIC (AMENDMENT) BYE-LAWS, 1953. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
WHEREAS the Commissioner of the Garda Síochána has before making the bye-laws hereinafter set forth, consulted the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin, the Council of the County Dublin, and the Corporation of Dún Laoghaire : |

NOW, I, DANIEL COSTIGAN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by subsection (1) of section 149 of the Road Traffic Act, 1933 (No. 11 of 1933), and of every and any other power me in this behalf enabling, hereby, with the consent of the Minister for Local Government, testified by his official seal affixed hereto, make the following bye-laws in respect of the Dublin Metropolitan Area, that is to say :-- |

1.--(1) These bye-laws may be cited as the Dublin Traffic (Amendment) Bye-Laws, 1953. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The principal bye-laws and these bye-laws may be cited together as the Dublin Traffic Bye-Laws, 1937 and 1953. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
2.--(1) In these bye-laws-- |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
the expression " the principal bye-laws " means the Dublin Traffic Bye-Laws, 1937 ( S. R. & O. No. 241 of 1937 ) ; |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
the expression " stopping place " means a place (including a stand or a starting point) at which an omnibus ordinarily stops for the purpose of taking up passengers. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) These bye-laws shall be construed together with the principal bye-laws. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these bye-laws. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
4.--(1) The roadway carried by O'Connell Bridge shall, for the purpose of the regulation of traffic crossing the Bridge, be deemed to be two separate thoroughfares, that is to say, a thoroughfare (in this bye-law referred to as the eastern thoroughfare) between the central island and the footway on the eastern side of the Bridge and a thoroughfare (in this bye-law referred to as the western thoroughfare) between the central island and the footway on the western side of the Bridge. |

(2) No person shall drive or lead a vehicle along or through the eastern thoroughfare in a direction other than southerly and no person shall drive or lead a vehicle along or through the western thoroughfare in a direction other than northerly. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
5.--(1) Each of the streets or portions of a street mentioned in column (2) of the First Schedule to these bye-laws shall be a one-way street during the period or times mentioned in column (4) of the said Schedule opposite the mention of such street or portion of a street in the said column (2). |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) No person shall drive, lead or conduct any vehicle along or through any street or portion of a street mentioned in column 2 of the First Schedule to these bye-laws during any period or time for or at which it is a one-way street in any direction other than in the direction mentioned in column (3) of the said Schedule opposite the mention of such street or portion of a street in the said column (2). |

6.--(1) Vehicles shall not turn to the right at an intersection mentioned in column (2) of the Second Schedule to these bye-laws when proceeding in a direction indicated in column (3) of the said Schedule opposite the mention of the intersection in the said column (2). |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) A person who drives a vehicle in such manner that the vehicle contravenes this bye-law shall be deemed to have contravened this bye-law and to have done an act which is for the purposes of subsection (2) of section 149 of the Road Traffic Act, 1933 (No. 11 of 1933), a contravention of a regulation made under that section. |

7.--(1) Where persons are waiting at a stopping place to enter an omnibus, they and each of them shall behave in an orderly manner and shall comply with all directions (including directions to form and keep in a queue) given by a member of the Gárda Síochána on duty at the stopping place or by an official in the employment of the owner of the omnibus acting within the scope of his employment. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) Where persons are waiting at a stopping place to enter an omnibus and no directions are given to them under paragraph (1) of this bye-law, they and each of them shall, in accordance with any notice or indication displayed at the stopping place by the owner of the omnibus, form and keep in a queue of : |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) if the notice or indication specifies that the queue shall be a queue of a particular number abreast--that number abreast, |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) if the notice or indication specifies that the queue shall be a queue of not more than a particular number abreast--not more than that number abreast, or |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) in any other case--not more than two abreast. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) Where-- |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) six or more persons are waiting at a stopping place to enter an omnibus, and |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) no directions are given to them under paragraph (1) of this bye-law, and |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) no notice or indication such as is mentioned in paragraph (2) of this bye-law is displayed at the stopping place, |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
they and each of them shall form and keep in a queue of not more than two abreast at the stopping place. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) Where persons waiting to enter an omnibus form in a queue in compliance with paragraph (3) of this bye-law they and each of them shall comply with the following requirements : |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) the queue shall face in the direction from which the omnibus will arrive, |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) the queue shall be formed on the footway at which the omnibus will stop or, where there is no footway, on the side of the roadway at which the omnibus will stop and as close as possible to the edge of the roadway or, where the stopping place is at or near the centre of the roadway, as close as possible to the centre of the roadway, |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) if there is a sign or notice at the stopping place where the queue is formed indicating that it is a stopping place, the queue shall commence at the sign or notice. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) Where persons waiting to enter an omnibus form in a queue in compliance with this bye-law or a direction under this bye-law-- |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) no person shall take a position in the queue otherwise than behind the persons already forming the queue, |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) no person shall enter the omnibus before any other person desiring to enter who stood in front of him in the queue, |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) no person, having left the queue, shall rejoin it otherwise than behind the persons forming the queue when he rejoins it unless an official in the employment of the owner of the omnibus permits him to retake his former position, |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) no person who has not been waiting in the queue may enter the omnibus before any other person desiring to enter the omnibus who has waited in the queue unless an official in the employment of the owner of the omnibus permits him to do so on account of his being unable owing to illness or infirmity to join the queue, |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(e) no person shall enter the omnibus until all persons desiring to alight from the omnibus at the stopping place where the queue is formed have alighted. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
8. Bye-law 6 and bye-law 10 of, and the Third Schedule to, the principal bye-laws, and the Dublin Traffic (Amendment) Bye-laws, 1941 (S.R. & O., 127 of 1941), are hereby revoked. |

WHEREAS in pursuance of section 8 of the Road Traffic Act, 1933 (No. 11 of 1933), the Commissioner has submitted the foregoing bye-laws to the Minister for Local Government ; AND WHEREAS the provisions of subsections (1) and (5) of the said section 8 have been complied with in relation to the said bye-laws ; NOW THEREFORE the Minister for Local Government ir exercise of the power conferred on him by section 149 of the said Act hereby consents to the making of the said bye-laws. |
