I, GERARD SWEETMAN, Minister for Finance, in exercise of, the powers conferred on me by section 8 of the Superannuation Act, 1887, as amended by section 35 of the Finance Act, 1956 (No. 22 of 1956), hereby make the following regulations : |
||
1. These Regulations may be cited as the Superannuation Act, 1887 (Section 8) Regulations, 1956. |
||
2. Each Department of State which is liable to account for a Vote of the Oireachtas as shown in the annual estimates for public services shall be a prescribed department for the purpose of section 8 of the Superannuation Act, 1887, or of that section as applied by any other enactment. |
||
3. An application for payment or distribution under section 8 of the Superannuation Act, 1887, or under that section as applied by any other enactment, shall be accompanied by a statutory declaration containing declarations in relation to the deceased person in the form set out in the Schedule to these Regulations. |
||
4. The Order under section 8 of the Superannuation Act, 1887, dated the 10th day of May, 1915, is hereby revoked. |

SCHEDULE. |
||

2. The said deceased person left no Will (or It is not intended to prove the Will of the said deceased person) and letters of administration to the said deceased person's estate have not been, nor are intended to be, taken out. |
||
3. The whole amount due and payable to the said deceased person from public funds does not exceed £500. |
||
4. The relations left by the said deceased person are as follows : |
||
(names of the survivors, together with the age and relationship of each of them, to be stated here). |

EXPLANATORY NOTE. |
||
These Regulations increase from £100 to £500 the limit within which an amount due by a public department in respect of a deceased civil servant by way of civil pay or superannuation may be paid without probate of will or other proof of title. |
