S.I. No. 229/1967:

SOCIAL WELFARE (ABSENCE FROM THE STATE (AMENDMENT) REGULATIONS, 1967.

SOCIAL WELFARE (ABSENCE FROM THE STATE (AMENDMENT) REGULATIONS, 1967.

I, JOSEPH BRENNAN, Minister for Social Welfare, in exercise of the powers conferred on me by sections 3 , 13 and 31 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby make the following Regulations:--

1. (1) These Regulations may be cited as the Social Welfare (Absence from the State) (Amendment) Regulations, 1967.

(2) These Regulations and the Social Welfare (Asence from the State) Regulations, 1967 ( S.I. No. 97 of 1967 ), may be cited together as the Social Welfare (Absence from the State) Regulations, 1967.

2. In these Regulations "the Principal Regulations" means the Social Welfare (Absence from the State) Regulations, 1967.

3. Paragraph (a) of sub-article (1) of article 4 of the Principal Regulations is hereby amended by the deletion of the semi-colon at the end of clause (iii) and by the insertion of "or" after "behalf" and by the insertion after the said clause (iii) of the following clauses--

"(iv) if the person has attained the age, in the case of a woman, of sixty years and in the case of a man of sixty-five years and, being in Northern Ireland, is permanently resident there, or

(v) while he is a person to whom the provisions of the Social Welfare Acts, 1952 to 1960, which govern the payment of employment contributions apply by virtue of article 13C of the Social Welfare (Contributions) Regulations, 1953 ( S.I. No. 5 of 1953 ), inserted by the Social Welfare (Contributions) (Amendment) Regulations, 1961 ( S.I. No. 139 of 1961 );"

4. Sub-article (1) of article 4 of the Principal Regulations is hereby further amended by the insertion after paragraph (b) thereof of the following paragraph--

"(bb) for receiving unemployment benefit (including any increase thereof) if the person has attained the age, in the case of a woman, of sixty years and in the case of a man of sixty-five years and, being in Northern Ireland, is permanently resident there;"

EXPLANATORY NOTE.

These Regulations amend the Social Welfare (Absence from the State) Regulations, 1967 ( S.I. No. 97 of 1967 ) which allow payment of benefit to persons abroad in certain circumstances.

These Regulations provide for the payment of disability and unemployment benefit (including any increases) to insured persons, otherwise qualified, who are permanently resident in Northern Ireland and who are aged sixty years in the case of a woman and sixty-five in the case of a man. As persons under these ages are covered by the 1964 Reciprocal Agreement special provision for them has not to be made. The Regulations further provide that despite their absence from the State persons who are employed abroad and continue to be insured under the Social Welfare Acts while so employed, may, if otherwise qualified, be paid disability benefit if they become ill.
