BRUCELLOSIS IN CATTLE (CONTROL OF VACCINATIONS) ORDER, 1968.

BRUCELLOSIS IN CATTLE (CONTROL OF VACCINATIONS) ORDER, 1968.

I, NEIL T. BLANEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by sections 3 and 13 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows:--

1. (1) This Order may be cited as the Brucellosis in Cattle (Control of Vaccinations) Order, 1968.

(2) This Order shall come into operation on the 15th day of August, 1968.

2. In this Order--

"animal" means a bovine animal;

"anti-abortion vaccine" means any vaccine intended for use in the vaccination of an animal against brucellosis;

"approved killed vaccine" means an anti-abortion vaccine which does not contain any living organism and for which a manufacturer's licence or an import licence has been granted under section 6 or section 9 of the Therapeutic Substances Act, 1932 (No. 25 of 1932);

" approved vaccination ear-tag " means an ear-tag supplied by the Minister for use in connection with the vaccination of an animal against brucellosis;

" brucellosis ", except in Article 1, means brucellosis in cattle;

" herd " includes a herd consisting of one animal only;

" the Minister " means the Minister for Agriculture and Fisheries.

3. No person other than a veterinary surgeon shall vaccinate any animal with anti-abortion vaccine.

4. An animal shall not be vaccinated against brucellosis except with an approved killed vaccine.

5. (1) Subject to paragraph (3), a veterinary surgeon shall not vaccinate an animal with an approved killed vaccine except with the permission in writing of the Minister.

(2) The Minister may in relation to a particular period of time or to any area or herd give a general permission in writing for the vaccination of animals in accordance with this Order.

(3) Where a general permission is given under paragraph (2) of this Article by the Minister--

(a) in case the permission relates to a particular period of time--paragraph (1) of this Article shall be of no effect for as long as the period remains unexpired and the permission is not withdrawn, and

(b) in case the permission relates to an area or herd--the said paragraph (1) shall not apply in relation to the area or herd, as may be appropriate, for as long as the permission is not withdrawn.

(4) (a) The Minister may in giving a permission under paragraph (1) or (2) of this Article attach to and specify in the permission any conditions and may at any time withdraw the permission and in the case of a permission given under the said paragraph (2) the Minister may annul or modify any conditions attached to the permission.

(b) A condition attached to any permission given under this Article shall be complied with.

6. Where a vaccination of an animal with an approved killed vaccine has been completed the veterinary surgeon who carried out the vaccination shall insert an approved vaccination ear-tag in the left ear of the animal if the animal does not already bear an approved vaccination ear-tag.

7. No person shall alter or remove any ear-tag inserted pursuant to this Order or insert any ear-tag that could be confused with such an ear-tag.

8. The Diseases of Animals (Control of Vaccinations) Order, 1966 ( S.I. No. 199 of 1966 ) is hereby revoked.

EXPLANATORY NOTE.

This Order provides that (1) vaccination of cattle with anti-abortion vaccine shall be carried out only by a veterinary surgeon; (2) an animal shall not be vaccinated against brucellosis except with an approved killed vaccine; (3) vaccination may be carried out only with the permission of the Minister; (4) where permission to vaccinate an animal is given the Minister may attach conditions; and (5) the veterinary surgeon carrying out the vaccination shall insert an approved vaccination ear-tag in the left ear of the animal on completion of the vaccination.

The Order revokes the Brucellosis in Cattle (Control of Vaccinations) Order, 1966 ( S.I. No. 199 of 1966 ).
