I, PATRICK S. DONEGAN, Minister for Fisheries, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Regulation (EEC) No. 103/76 of 19 January, 1976, hereby make the following regulations: |

1. These Regulations may be cited as the European Communities (Marketing of Fish) Regulations, 1977, and shall come into operation on the 1st day of May, 1977. |

2. In these Regulations-- |

"the Council Regulation" means Council Regulation (EEC) No. 103/76 of 19 January, 19761; |

"marketing" has the meaning assigned to it by Article 1 of the Council Regulation. |
||
3. Any person who in marketing fish contravenes or fails to comply with a requirement of the Council Regulation shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £200. |

4. An offence under these Regulations may be prosecuted by the Minister for Fisheries. |

EXPLANATORY NOTE. |
||
These Regulations make it an offence to market certain varieties of fish for human consumption unless they have been graded and labelled in accordance with the specifications contained in Council Regulation (EEC) No. 103 of 1976 which lays down common marketing standards for fish offered for sale in Community markets, any such offence to be liable to prosecution and on conviction to a fine not exceeding £200. The varieties in question include cod, haddock, whiting, saithe (black pollock or coley), plaice, hake, herring and mackerel. |
