INDUSTRIAL AND PROVIDENT SOCIETIES (FEES) REGULATIONS, 1978

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 73 of the Industrial and Provident Societies Act, 1893, as adapted by section 2 of the Registry of Friendly Societies Act, 1936 (No. 51 of 1936), and the Industry and Commerce (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 306 of 1977 ), hereby, with the consent of the Minister for Finance, make the following Regulations:

1. These Regulations may be cited as the Industrial and Provident Societies (Fees) Regulations, 1978.

2. These Regulations shall come into operation on the 14th day of April, 1978.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. (1) The fees to be paid for matters to be transacted or for the inspection of documents under the Industrial and Provident Societies Acts, 1893 to 1971, shall be the fees that are specified in Part I of the Schedule to these Regulations.

(2) No fee shall be payable for the services specified in Part II of the Schedule to these Regulations.

5. The Regulations dated December 31, 1906, and made by the Treasury, are hereby revoked.

SCHEDULE.

PART I.

SERVICES FOR WHICH FEES ARE PAYABLE.

Provided that the Registrar may, at his discretion, reduce the fee payable for the acknowledgement of registry to not less than £10.00 in the case of any Society whose objects or rules or any other special circumstances, in his opinion, entitle such Society to such reduction.
2. Acknowledgement of registry of an amendment of rules-- 20.00

( a ) complete amendment

( b ) partial amendment

3. Registry of a special resolution (including approval of change of name) 8.00
4. Appointment of inspector or calling of special meeting 20.00
5. Determination on a dispute or an award for the distribution of funds--

( a ) where the matter is settled without a hearing or on one hearing without adjournment

( b ) for every hearing after the first and for every adjournment

6. For the signature or seal of the Registrar to a document not chargeable with any other fee 1.00
7. Inspection of a Society's file 0.25
8. Copy or extract of any document (in addition to a fee for the Registrar's signature) Such fee as may be fixed by the Registrar.
9. Filing of documents concerning the winding up of a Society under the provisions of the Companies Act, 1963

Such fee as may be specified in the Eighth Schedule to the Companies Act, 1963 .

PART II.

SERVICES FOR WHICH NO FEE IS CHARGEABLE.

1. Cancellation or suspension of the registration of a Society.

2. Filing of notice of change of registered office.

3. Filing of an instrument of dissolution or any amendment thereto.

4. Any document or copy document supplied to a public department.

5. The provision of any document in respect of which a fee is chargeable under any other Act or under any other provision of the Industrial and Provident Societies Acts, 1893 to 1971.

The purpose of these Regulations is to increase the fees to be paid for matters to be transacted or for the inspection of documents under the Industrial and Provident Societies Acts, 1893 to 1971.
