I, ALAN DUKES, Minister for Justice, in exercise of the powers conferred on me by section 3 of the Irish Nationality and Citizenship Act, 1956 (No. 26 of 1956), hereby make the following Regulations:

1. These Regulations may be cited as the Irish Nationality and Citizenship Regulations, 1986.

2. In these Regulations "the Regulations of 1956" means the Irish Nationality and Citizenship Regulations, 1956 ( S.I. No. 216 of 1956 ).

3. Regulation 4 of the Regulations of 1956 is hereby amended by the deletion of "woman".

4. The form set out in Schedule 1 to these Regulations is hereby substituted for Form 3 in the Schedule to the Regulations of 1956.

5. The form set out in Schedule 2 to these Regulations is hereby substituted for Form 5 in the Schedule to the Regulations of 1956.

6. Forms 6 and 7 in the Schedule to the Regulations of 1956 are hereby amended by the substitution of "18 years" for "twenty-one years".

7. Form 12 in the Schedule to the Regulations of 1956 is hereby amended by the substitution of "Declaration of alienage by a person who is of full age." for "Declaration of alienage by a person who is either of full age or a married woman under that age".

Except in the case of a woman who is an alien and is making a declaration prior to the 1st day of January, 1987, this declaration must be supported by an affidavit by the spouse who is an Irish citizen to the effect that the couple are living together as husband and wife. The declaration and the affidavit should be made:--

If made in Ireland before a notary public or a commissioner for oaths or a peace commissioner, and if made elsewhere, before a diplomatic or consular officer of Ireland, a notary public, or an person who is by the law of the country in which the declaration is made a commissioner for oaths or other person authorised to take affidavits and for that purpose to administer oaths.

NOTES

Names should be written in block (capital) letters. The application must not be made in a name the use of which is prohibited by Section 8 of the Aliens Act, 1935 .

Nationality should be stated by reference to a sovereign State. If the applicant has no nationality he should state so under Heading 7 and he should slate under Heading 25 how and when he lost his nationality.

Headings 8 to 30 need not be answered and no reference need be furnished by an applicant who is a refugee within the meaning of the United Nations Convention relating to the Status of Refugees of the 28th day of July, 1951, and the Protocol Relating to the Status of Refugees of the 31st day of January, 1967, or is a Stateless person within the meaning of the United Nations Convention relating to the Status of Stateless Persons of the 28th day of September, 1954.

If there is not sufficient space on the application form for a statement of any particulars, those particulars should be furnished in a separate statement which should be attached to the form and should be signed by the applicant in the presence of the person before whom the statutory declaration is made.

The application, when completed, should be sent to the Secretary, Department of Justice. Dublin 2.

WARNING

A false statement on this Form is an offence punishable by a fine of up to £500 and/or imprisonment for up to six months.
