I, JOHN P. WILSON, Tanaiste and Minister for the Marine, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), and after due compliance with Section 106 of the said Harbours Act, 1946 , hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Wicklow Harbour) Order, 1991.
|
|
|
(2) This Order shall come into operation on the 18th day of March, 1991.
|
|
|
2. In this Order "the Order of 1988" means the Harbour Rates (Wicklow Harbour) Order, 1988 ( S.I. No. 157 of 1988 ).
|
|
|
3. (1) The Harbour Rates (Wicklow Harbour) Order, 1949 ( S.I. No. 172 of 1949 ), is hereby amended by--
|
|
|
( a ) the substitution for the First Schedule (inserted by the Order of 1988) thereto of the following Schedule:

Rates on fishing vessels: |

As a composition in full in lieu of tonnage rates on every fishing vessel entering the harbour for the purpose of landing fish, per year: |

On every fishing vessel entering the harbour for any purpose other than landing fish, for each entry: |

(c) |
On every fishing vessel entering the harbour windbound, per entry: |

The rates at 2 (b) and (c) are chargeable for each stay in the harbour of seven days or part thereof. |

3. |
Rates on Pleasure Boats: |
|
(a) (i) |
On every open pleasure boat of 1 ton gross or under, not being a pleasure boat described in Clause (ii) of this subparagraph, as a composition in full in lieu of tonnage rates payable yearly in advance, a sum of: |
£5.80 |
(ii) |
On every open pleasure boat of 1 ton gross or under with cuddy or cabin not exceeding six feet in length as a composition in full in lieu of tonnage rates payable yearly in advance, a sum of: |
£16.20 |

For vessels remaining in the harbour between 7 and 14 days a further: |
£9.80 |
|
For vessels remaining in the harbour between 14 and 21 days a further: |
£17.40 |
|
And for every 7 days or part thereof over 21 days a further: |

|
|
( c ) the substitution for the Third Schedule (inserted by the Order of 1988) thereto of the following Schedule:

Provided that reasonable use and enjoyment of any quay is not interfered with or obstructed, goods authorised to be placed on the quays whether for import or export, may remain on the quay, free of charge, for a period of seven days exclusive of Saturdays, Sundays and Public Holidays, hereinafter referred to as "the Permitted Period"; |

1. (1) |
For every square metre occupied by the goods after the expiration of the permitted period; |
|
(i) |
For the first seven days |

2. |
Ballast, per tonne-- |

For the use of any wharf, pier or quay for the launching, lifting out, repairing, fitting or servicing of vessels, per period of seven days or part thereof: |

(2) Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:
|
|
|
( a ) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes,
|
|
|
( b ) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes,
|
|
|
( c ) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 Kilogrammes,
|
|
|
( d ) any weight exceeding 750 kilogrammes but not exceeding 1 tonne shall count as 1 tonne.
|
|
|
4. The Harbour Rates (Wicklow Harbour) Order, 1988 ( S.I. No. 157 of 1988 ), is hereby revoked.

EXPLANATORY NOTE.
|
|
|
This Order authorises Wicklow Harbour Commissioners to charge goods and tonnage rates at Wicklow Harbour.
