ROAD TRAFFIC (LICENSING OF TRAILERS AND SEMI-TRAILERS) (AMENDMENT) REGULATIONS, 1996.

The Minister for the Environment in exercise of the powers conferred on him by section 5 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 10 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following regulations:--

1. (1) These Regulations may be cited as the Road Traffic (Licensing of Trailers and Semi-Trailers) (Amendment) Regulations, 1996.

(2) The Road Traffic (Licensing of Trailers and Semi-Trailers) Regulations, 1982 to 1990 and these Regulations shall be construed as one and may be cited together as the Road Traffic (Licensing of Trailers and Semi-Trailers) Regulations, 1982 to 1996.

2. These Regulations shall be deemed to have come into operation on the 1st day of January, 1996.

3. The Road Traffic (Licensing of Trailers and Semi-Trailers) Regulations, 1982 ( S.I. No. 35 of 1982 ) are hereby amended by--

( a ) the insertion in article 22 of the words "Subject to the provisions of article 23 of these Regulations," before the words "Any amounts paid" and

(b) the addition of the following article--

"23. In respect of the specified fees payable under article 21 of these Regulations and collected by any licensing authority, that authority may, before payment into the Exchequer of such fees, deduct from moneys so collected, an amount calculated in accordance with directions in writing issued by the Minister for the Environment, with the consent of the Minister for Finance, in respect of expenses properly incurred by the licensing authority in respect of the collection of such fees.".

EXPLANATORY NOTE.

These Regulations enable licensing authorities to meet their expenses under the Trailers and Semi-Trailers Regulations by way of deduction of a specified amount from fees collected under the Regulations before payment of such fees to the Exchequer. The Regulations come into effect on 1st January, 1996.
