SOCIAL WELFARE ACT, 1998 (SECTION 20) (COMMENCEMENT) ORDER, 1998.

SOCIAL WELFARE ACT, 1998 (SECTION 20) (COMMENCEMENT) ORDER, 1998.

The Minister for Social, Community and Family Affairs, in exercise of the powers conferred on the Minister by section 25 of the Social Welfare Act, 1998 (No. 6 of 1998), hereby orders as follows:

Citation

1. This Order may be cited as the Social Welfare Act, 1998 (Section 20) (Commencement) Order, 1998.

Commencement

2. The 4th day of June, 1998, is hereby appointed as the day on which section 20 of the Social Welfare Act, 1998 (No. 6 of 1998), shall come into operation.

EXPLANATORY NOTE.

This Order provides that section 20 of the Social Welfare Act, 1998 will come into effect on the 4th of June, 1998.

Section 20 extends recovery of overpayment procedures to provide for the recovery of money paid to someone, other than the beneficiary, who was not entitled to such payment.

Any social insurance or social assistance overpayment may be recovered by way of deduction from any other social insurance or social assistance payment (other than Supplementary Welfare Allowance) to which the person is or becomes entitled. Section 20 extends these provisions to include Family Income Supplement.
