OIREACHTAS (ALLOWANCES TO MEMBERS) (TRAVELLING FACILITIES AND OVERNIGHT ALLOWANCE) (AMENDMENT) REGULATIONS, 1998.

OIREACHTAS (ALLOWANCES TO MEMBERS) (TRAVELLING FACILITIES AND OVERNIGHT ALLOWANCE) (AMENDMENT) REGULATIONS, 1998.

I, CHARLIE McCREEVY, Minister for Finance, in exercise of the powers conferred on me by sections 1 (inserted by section 2 of the Oireachtas (Miscellaneous Provisions) and Ministerial and Parliamentary Offices (Amendment) Act, 1996 (No. 39 of 1996), as amended by section 15 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act, 1998 (No. 5 of 1998) (" the Act of 1998 ")) and 3 (as amended by section 17 of the Act of 1998) of the Oireachtas (Allowances to Members) Act, 1962 (No. 32 of 1962), section 5 (as amended by section 18 of the Act of 1998) of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1964 (No. 14 of 1964), and the Public Service (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 81 of 1987 ), hereby make the following regulations:

1. (1) These Regulations may be cited as the Oireachtas (Allowances to Members) (Travelling Facilities and Overnight Allowance) (Amendment) Regulations, 1998.

(2) These Regulations shall be deemed to have come into operation on the 1st day of May, 1998.

2. The Oireachtas (Allowances to Members) (Travelling Facilities and Overnight Allowance) Regulations, 1998 ( S.I. No. 101 of 1998 ), are hereby amended--

(a) in Regulation 4, by the substitution--

(i) in paragraph (a), for "paragraph (b) (ii) (I)" of "paragraph (b) (ii) ",

(ii) in subparagraph (i) of paragraph (b), for "paragraph (b) (ii) (I)" of "paragraph (b) (ii) ", and

(iii) in paragraph (b), for subparagraph (ii) of the following subparagraph:

"(ii) a mileage allowance at the rates payable to civil servants for cars coming within the highest engine capacity category in respect of each relevant period.",

(b) by the insertion of the following Regulation after Regulation 10:

"10A. The form in which a member may make a claim for payment of an allowance under these Regulations shall be in the form set out in the Schedule to these Regulations.",

(c) in Regulation 11 (b), by the insertion after "1994" of "( S.I. No. 343 of 1994 ) ", and

(d) by the insertion after Regulation 11 of the following Schedule:

Claim Form for Member of the Houses of the Oireachtas in respect of Travelling Facilities and Overnight Allowances

Section A

(Applies only to a member of either House of the Oireachtas whose normal place of residence for the time being is within 15 miles of Leinster House, or to a member whose normal place of residence for the time being is more than 15 miles from Leinster House and who opts to claim under Regulation 4(b)(i).)

Claim A -- This claim is for travelling facilities in respect of travelling expenses which I incurred in respect of my attendance, during the period of this claim, at Leinster House. I hereby claim the flat-rate daily travel allowance in respect of ......... days during the claim period.

Section B

(Applies to a member of either House of the Oireachtas whose normal place of residence for the time being is more than 15 miles from Leinster House and who opts to claim under Regulation 4(b)(ii).)

Claim B.1 -- This claim is for travelling facilities in respect of travelling expenses which I incurred in respect of my attendance, during the period of this claim, at Leinster House. I hereby claim mileage allowances in respect of ......... one-way journeys between my normal place of residence for the time being and Leinster House each being of ......... miles.

Claim B.2.i -- This claim is for overnight allowances in respect of overnight stays which I made in the Dublin area in respect of my attendance, during the period of this claim, at meetings of Dáil Éireann or Seanad Éireann or of Committees thereof, of which I was a member or a duly nominated substitute. I claim the overnight allowances in respect of ......... overnight stays in the Dublin area.

Claim B.2.ii -- This claim is for overnight allowances in respect of overnight stays (on occasions for which I was not entitled to an allowance under B.2.i above) which I made in the Dublin area in respect of my attendance, during the period of this claim, at meetings held in Leinster House between members of either or both Houses of the Oireachtas to discuss parliamentary business. I claim the overnight allowances in respect of ......... overnight stays in the Dublin area. (Note: maximum of 5 overnight allowances per annum payable under this provision.)

Claim B.2.iii -- This claim is for overnight allowances in respect of overnight stays (on occasions for which I was not entitled to an allowance under B.2.i or B.2.ii above) which I made in the Dublin area in respect of my attendance, during the period of this claim, at Leinster House for the purpose of using its facilities. I claim the overnight allowances in respect of ......... overnight stays in the Dublin area. (Note: maximum of 25 overnight allowances per annum payable under this provision.)
