OIREACHTAS (TERMINATION ALLOWANCE) (AMENDMENT) (NO. 2) REGULATIONS, 1998

OIREACHTAS (TERMINATION ALLOWANCE) (AMENDMENT) (NO. 2) REGULATIONS, 1998

I, CHARLIE McCREEVY, Minister for Finance, in exercise of the powers conferred on me by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (No. 3 of 1992), hereby make the following Regulations:

1. These Regulations may be cited as the Oireachtas (Termination Allowance) (Amendment) (No. 2) Regulations, 1998:

2. Regulation 3(1) of the Oireachtas (Termination Allowance) Regulations, 1992 ( S.I. No. 356 of 1992 ), is hereby amended by the substitution for the definition of "additional allowance" of the following definition--

"'additional allowance' means an allowance payable pursuant to section 3 or 4 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act, 1994 (No. 5 of 1998), or which was payable pursuant to section 2 or 3 of the Oireachtas (Allowances to Members) (Amendment) Act, 1994 (No. 21 of 1994);".

3. Where a member is paid one or more rapporteur allowances, within the meaning of Clause 4A (inserted by the Houses of the Oireachtas (Members) Pensions (Amendment) (No. 2) Scheme ( S.I. No. 373 of 1998 ) ("the 1998 No. 2 Scheme")) of the Houses of the Oireachtas (Members) Pensions (Amendment) Scheme, 1997 ( S.I. No. 212 of 1997 ) ("the 1997 Scheme"), these allowances may be treated for the purposes of the Oireachtas (Termination Allowance) Regulations, 1992 ( S.I. No. 356 of 1992 ), as if--

(a) they were additional allowances,

(b) the allowances were paid in respect of a position,

and

(c) the annual rate for the time being appropriate to the position and the number of days over which the allowance was deemed to have been paid were determined under paragraph (a) of Clause 4A and subclause (3) of Clause 5 of the 1997 Scheme, (inserted by the 1998 No. 2 Scheme).
