PETROLEUM OILS (REGULATION OR CONTROL OF ACQUISITION, SUPPLY, DISTRIBUTION OR MARKETING) (CONTINUANCE) ORDER, 1999.

PETROLEUM OILS (REGULATION OR CONTROL OF ACQUISITION, SUPPLY, DISTRIBUTION OR MARKETING) (CONTINUANCE) ORDER, 1999.

WHEREAS there is for the time being in force an Order (entitled the “Petroleum Oils (Regulation or Control of Acquisition, Supply, Distribution or Marketing) Order, 1983 ( S.I. No. 1 of 1983 ”) under subsection (1) of section 2 of the Fuels (Control of Supplies) Act, 1971 ( No. 3 of 1971 ) (as amended by the Fuels (Control of Supplies) Act, 1982 (No. 18 of 1982) ) declaring that the Government are of the opinion that the exigencies of the common good necessitate the regulation or control by the Minister for Industry and Energy on behalf of the State of the acquisition, supply, distribution or marketing of petroleum oils;

WHEREAS the reference in the said Order to the Minister for Industry and Energy is to be construed as the Minister for Public Enterprise by virtue of the Transport, Energy and Communications (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 299 of 1997 );

WHEREAS the said Order has been continued in force by virtue of continuance orders made under subsection (4) of the said section 2 (as so amended);

WHEREAS the said Order as so continued would (but for this Order) expire on the 31st day of December, 1999;

AND WHEREAS the Government are of the opinion that the exigencies of the common good still necessitate the regulation or control by the Minister for Public Enterprise on behalf of the State of the acquisition, supply, distribution or marketing of petroleum oils;

NOW the Government, in exercise of the powers conferred on them by subsection (4) of section 2 of the Fuels (Control of Supplies) Act, 1971 ( No. 3 of 1971 ) (as amended by the Fuels (Control of Supplies) Act, 1982 (No. 18 of 1982) ), hereby order as follows:

1. This Order may be cited as the Petroleum Oils (Regulation or Control of Acquisition, Supply, Distribution or Marketing) (Continuance) Order, 1999.

2. The Petroleum Oils (Regulation or Control of Acquisition, Supply, Distribution or Marketing) Order, 1983 ( S.I. No. 1 of 1983 ), shall continue in force for the period of 12 months from the date upon which (but for this Order) it would have expired.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order will continue to confer on the Minister for Public Enterprise for the duration of the year 2000, powers to regulate or control on behalf of the State, the acquisition, supply, distribution or marketing or petroleum oils in any possible emergency situation and also, will allow the continuation of the Whitegate offtake regime.
