European Communities (Financial Transparency) (Amendment) Regulations 2006


Made by the Minister for Finance

I, Brian Cowen, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 2005/81/EC of 28 November 20051 , hereby make the following Regulations:

Citation.

1.         These Regulations may be cited as the European Communities (Financial Transparency) (Amendment) Regulations 2006.

Undertaking required to maintain separate accounts.

2.         Regulation 2 of the European Communities (Financial Transparency) Regulations 2004 ( S.I. No. 693 of 2004 ) is amended by substituting the following for the definition of -�undertaking required to maintain separate accounts-�:

-�-�undertaking required to maintain separate accounts' means an undertaking that enjoys a special right or exclusive right granted by a Member State pursuant to Article 86(1) of the Treaty, or that is entrusted with the operation of a service of general economic interest pursuant to Article 86(2) of the Treaty and receives public service compensation in any form whatsoever, including any grant, support or compensation, in relation to such service and which carries on other activities.-�.
