SOCIAL WELFARE AND PENSIONS ACT 2008 (SECTIONS 15 AND 16) (COMMENCEMENT) ORDER, 2009

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 21st April, 2009.

The Minister for Social and Family Affairs, in exercise of the powers conferred on her by Section 1(6) of the Social Welfare and Pensions Act 2008 (No. 2 of 2008), hereby orders as follows:

1. This Order may be cited as the Social Welfare and Pensions Act 2008 (Sections 15 and 16) (Commencement) Order 2009.

2. The 1st day of April 2009 is appointed as the day on which Sections 15 and 16(a), (b), (d), (e), (f), (g), (h) and (i) of the Social Welfare and Pensions Act 2008 (No. 2 of 2008) come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order provides for the commencement of Sections 15 and 16, other than paragraph (c), of the Social Welfare and Pensions Act 2008 .

Sections 15 and 16 set out the conditions for eligibility for receipt of Domiciliary Care Allowance, the rates of payment and consequential amendments to allow for the transfer of the administration of the scheme, in respect of new applications made on or after 1st April 2009, from the Health Service Executive to the Department of Social and Family Affairs.
