ENVIRONMENTAL PROTECTION AGENCY (ADVISORY COMMITTEE) REGULATIONS 2009

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 19th June, 2009.

The Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on him by sections 6, 27(5) and 27(16) of the Environmental Protection Agency Act 1992 (No. 7 of 1992), hereby makes the following Regulations-

1. These Regulations may be cited as the Environmental Protection Agency (Advisory Committee) Regulations 2009.

2. In these Regulations-

"the Act" means the Environmental Protection Agency Act 1992 ;

"Advisory Committee" means the Advisory Committee provided for in section 27 of the Act.

3. The prescribed organisations for the purposes of section 27(5)(a) of the Act shall be-

(a) The Agricultural Science Association,

(b) The County and City Managers Association,

(c) The Environmental Health Officers Association,

(d) The Institute of Chemistry of Ireland,

(e) The Institution of Engineers of Ireland,

(f) The Institution of Water and Environmental Management - Republic of Ireland Branch,

(g) The Irish Planning Institute,

(h) The Royal Town Planning Institute, Irish Branch - Southern Section,

(i) The Directors of Public Health of the Health Service Executive,

(j) Environmental Sciences Association of Ireland,

(k) Royal Institute of Architects of Ireland and

(l) Institute of Public Health in Ireland

4. The prescribed organisations for the purposes of section 27(5)(b) of the Act shall be-

(a) Fáilte Ireland,

(b) The Heritage Council, and

(c) The Irish Environmental Network.

5. The prescribed organisations for the purposes of section 27(5)(c) of the Act shall be-

(a) Forfás,

(b) The Irish Business and Employers Confederation,

(c) The Irish Congress of Trade Unions,

(d) The Irish Creamery Milk Suppliers Association,

(e) The Irish Farmers Association, and

(f) The Chambers of Commerce of Ireland.

6. The prescribed organisations for the purposes of section 27(5)(d) of the Act shall be-

(a) Aontacht Cumann Riartha Aitreabhthirí (A.C.R.A.),

(b) The Association of Municipal Authorities in Ireland,

(c) The General Council of County Councils,

(d) The Irish Countrywomen's Association,

(e) Muintir na Tíre,

(f) The National Association of Tenants Organisations,

(g) The National Women's Council of Ireland,

(h) The National Youth Council of Ireland,

(i) Planet,

(j) The Conference of Religious in Ireland,

(k) Forige,

(l) Community Workers' Coop and

(m) Irish Rural Link

7. The prescribed organisations for the purposes of section 27(5)(e) of the Act shall be-

(a) The Central Fisheries Board,

(b) The Industry Research and Development Group,

(c) The Marine Institute,

(d) The National Council for Curriculum and Assessment,

(e) The Royal Dublin Society,

(f) The Royal Irish Academy,

(g) Teagasc,

(h) The Higher Education Authority and

(i) Each of the Universities, within the meaning of section 4(1) of the Universities Act 1997 .

8. Where a request is made to prescribed organisations pursuant to section 27(7) of the Act the organisations shall, before the expiration of 4 weeks commencing on the day on which the request is made, inform the Minister of the names of the candidates selected and of the reasons why, in the opinion of the organisations, they are suitable for such appointment and shall send to the Minister a curriculum vitae in relation to each candidate together with a written consent of each candidate to the selection of that candidate in accordance with the request.

9. The Environmental Protection Agency (Advisory Committee) Regulations 2004 ( S.I. No. 816 of 2004 ) are hereby revoked.

These Regulations prescribe the various organisations for the purposes of selecting candidates for consideration for appointment by the Minister as members of the Advisory Committee of the Environmental Protection Agency and deal with related matters.
