I, NOEL DEMPSEY, Minister for Transport, in exercise of the power conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to the Directives specified in the Schedule to the following regulations, and for the purpose of giving effect to Article 10 of Regulation 715/2007 1 of the European Parliament and of the Council of 20 June 2007, Articles 9, 10 and 13 of Regulation (EC) No. 78/2009 2 of the European Parliament and of the Council of 14 January 2009, Articles 11 and 15 of Regulation (EC) No. 79/2009 3 of the European Parliament and of the Council of 14 January 2009, Articles 8, 9 and 11 of Regulation (EC) No. 595/2009
4 of the European Parliament and of the Council of 18 June 2009, and Articles 13(15) and 16 of Regulation (EC) No. 661/2009 5 of the European Parliament and of the Council of 13 July 2009, in so far as those Directives and Regulations apply to the type approval of motor vehicles and their trailers and two or three-wheel motor vehicles, and systems, components and seperate technical units intended for such vehicles, hereby make the following regulations;
|
|
|
1. These Regulations may be cited as the European Communities (Motor Vehicles Type Approval) (Amendment) Regulations 2010.
|
|
|
2. The European Communities (Motor Vehicles Type Approval) Regulations 2009 ( S.I. No. 127 of 2009 ) are amended-
|
|
|
(a) in Regulation 6(4), by substituting for subparagraphs (i) and (ii) the following:
|
|
|
"(i) the form set out in Schedule 2, or
|
|
|
(ii) in the case of a vehicle with four or more wheels to which Directive 2007/46/EC 6 applies (other than such a vehicle to which Directive 2002/24/EC 7 applies), the form set out in Annex IV to Commission Regulation (EC) 1060/2008 8 , or",
|
|
|
(b) in Regulation 9(2), by substituting for subparagraphs (i) and (ii) the following:
|
|
|
"(i) the form set out in Schedule 3, or
|
|
|
(ii) in the case of a vehicle with four or more wheels to which Directive 2007/46/EC 6 applies (other than such a vehicle to which Directive 2002/24/EC 7 applies), the form set out in the Annex to Regulation (EC) 385/2009 9 , or",
|
|
|
(c) in regulation 19 by substituting for paragraphs (1) and (2) the following:
|
|
|
"(1) A person who commits an offence under Regulation 17(2) or (4) is liable on summary conviction to a fine not exceeding €5,000.
|
|
|
(2) A person who commits an offence under Regulation 9(4), 10(2), 11(3), 12(3) or 18(1) is liable-
|
|
|
(a) on summary conviction, to a fine not exceeding €5,000 or imprisonment for a term not exceeding 3 months or both, and
|
|
|
(b) on conviction on indictment, to a fine not exceeding €100,000 or imprisonment for a term not exceeding 12 months or both.",
|
|
|
and
|
|
|
(d) by substituting for Schedule 1 the following:
|
|
|

The European Communities (Motor Vehicles Type Approval) Regulations 2009 ( S.I. No. 127 of 2009 ) implemented in Ireland those provisions of a number of European Community Directives which deal with the type approval of motor vehicles, their trailers and components, and two and three-wheel vehicles including quadricycles. The relevant EC Directives are listed in Schedule 1 to S.I. No. 127 of 2009 and Schedules 2 and 3 contain the relevant forms of Type Approval and Certificate of Conformity. These amending Regulations update S.I. No. 127 of 2009 by substituting a new Schedule 1 to take account of certain type approval Directives recently adopted.

Schedule 1 now includes amendments pursuant to the following:

In addition, amendments are made to S.I. No. 127 of 2009 in order to recognise Type Approval Certificates and Certificates of Conformity which take the form of those set out in Directive 2007/46/EC (as amended), and further, the penalty in respect of record keeping is now considered a summary offence only.

|
It must be noted that EC Regulations do not need transposition into Irish law, as they are directly binding throughout the Member States of the European Union. However, specific Articles of EC Regulations 715/2007, 78/2009, 79/2009, 595/2009 and 661/2009 are given effect by these Regulations in relation to penalties and in relation to their timetable of applicability to the type approval of motor vehicles, their trailers and systems, components and separate technical units. Annex IV of Council Directive 2007/46/EC of 5 September 2007 (as amended) on the type approval of motor vehicles and their trailers (O.J.
