I, LEO VARADKAR, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 18 of the section 2 of the Road Traffic Act 2006 (No. 23 of 2006) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 ) and for the purpose of giving effect to Commission Directive 2010/48/EU of 5 July 20101 , hereby make the following regulations: |

1. These Regulations may be cited as the Road Traffic (National Car Test) (Amendment) Regulations 2012. |
||
2. In these Regulations, "Principal Regulations" means the Road Traffic (National Car Test) (Amendment) Regulations 2011 ( S.I. No. 623 of 2011 ). |
||
3. The Principal Regulations are amended as follows: |
||
(1) By adding the following reasons for refusal to Item 30 of the Schedule- |
||
(15) light source and lamp not compatible. |
||
(16) where a levelling device is mandatory, the levelling device is not operating. |
||
(17) where a levelling device is mandatory, the levelling device cannot be operated from the driver's seat. |
||
(18) where a headlamp cleaning device is mandatory, the headlamp cleaning device is not operating correctly. |
||
(2) By amending Item 60 of the Schedule to read as follows: |
||
Malfunction indicator for airbags, electronic stability control (ESC), antilock brake system (ABS), electronic braking system (EBS), parking brake, tyre pressure monitoring systems (TPMS), electronic power steering (EPS) or brake fluid warning lamp is not working, or is indicating a defect in the system. |

These Regulations further define the standards and methods for vehicle testing. |
||
For these purposes, these Regulations amend the Road Traffic (National Car Test) (Amendment) Regulations 2011 ( S.I. No. 623 of 2011 ). |
