I, ALAN SHATTER, Minister for Justice and Equality, in exercise of the powers conferred on me by section 21 (1) of the Registration of Deeds and Title Act 2006 (No. 12 of 2006) (as adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minister) Order 2011) ( S.I. No. 138 of 2011 ), and with the consent of the Minister for Public Expenditure and Reform, hereby order as follows: |

1. (1) This Order may be cited as the Land Registration (Fees) (Amendment) Order 2013. |
||
(2) This Order shall come into operation on 28 January 2013. |
||
(3) This Order shall remain in force until 31 December 2013. |
||
2. The Land Registration (Fees) Order 2012 ( S.I. No. 380 of 2012 ) is hereby amended by the insertion of new Articles 1(3) and 1(4) as follows: |
||
“(3) Notwithstanding the provisions of Article 1(2) above, in the case of any application to the Authority, in respect of a service or matter, which was received by the Authority before 1 December 2012, the fees which applied before the coming into force of the Land Registration (Fees) Order 2012 will continue to apply. This will remain the case even in situations where the Authority has had to reject the application.” |

“(4) In the case of any application to the Authority in respect of a service or matter, which was received by the Authority on or after 1 December 2012, but where the Authority is advised by the Revenue Commissioners that but for unavoidable delays with the Revenue Commissioners, the application would have been likely to have been submitted to the Authority before 1 December 2012, the application shall be treated by the Authority as if it had been submitted before 1 December 2012 and the fees which applied before 1 December 2012 will continue to apply.” |

The Minister for Public Expenditure and Reform consents to the making of the foregoing Order. |
