Irish Statutory Instruments

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 13th September, 2013.

I, LEO VARADKAR, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2003/59/EC of the European Parliament and of the Council of 15 July 2003¹ , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Vehicle Drivers Certificate of Professional Competence) (Amendment) Regulations 2013.

2. The European Communities (Vehicle Drivers Certificate of Professional Competence) (No. 2) Regulations 2008 ( S.I. No. 359 of 2008 ) are hereby amended by the substitution, for Regulation 6 (2) (b), of the following:

“(b) is used by, or under the control of-

(i) the Garda Síochána,

(ii) the Defence Forces,

(iii) a fire brigade,

(iv) the Civil Defence, or

(v) the Irish Prison Service,”.

EXPLANATORY NOTE

These Regulations add the Irish Prison Service to the organisations exempted from the Certificate of Professional Competence regime.
