Bord na gCon in exercise of the powers conferred on it by Section 13 of the Greyhound Industry Act 1958 (No. 12 of 1958), as amended by Section 9 of the Horse and Greyhound Racing (Betting Charges and Levies) Act 1999 (No. 24 of 1999), and also by sub-section (3) of Section 5 of the said 1958 Act, hereby makes the following regulations, that is to say- |

1. These regulations may be cited as the Greyhound Industry (Control Committee and Control Appeal Committee) (Amendment) Regulations, 2015. |
||
2. The Greyhound Industry (Control Committee and Control Appeal Committee) Regulations, 2007 ( S.I. No. 301 of 2007 ), the Greyhound Industry (Control Committee and Control Appeal Committee) (Amendment) Regulations, 2008 ( S.I. No. 242 of 2008 ) and these regulations may be cited together as the Greyhound Industry (Control Committee and Control Appeal Committee) Regulations, 2007 to 2015. |

3. The Greyhound Industry (Control Committee and Control Appeal Committee) Regulations, 2007 are hereby amended as follows- |
||
(i) by the deletion of Article 8(6) in its entirety to be replaced with the following- |
||
"(6)(i) Where, for the purposes of sub-article (5) of this article, the Control Committee makes a decision in relation to an allegation that a person has contravened any provision in these Regulations, the racing regulations or any other direction or regulation made by the Board and for the time being in force, it shall publish its findings, and its reasons for such findings, in a manner it deems fit. |
||
(ii) In this sub-article a decision of the Control Committee includes a decision that a person has not contravened any provision in these Regulations, the racing regulations or any other direction or regulation made by the Board and for the time being in force." |

(ii) by the deletion of Article 14(33) in its entirety to be replaced with the following- |
||
"(33) Where the Control Appeal Committee makes a decision in relation to an appeal it shall publish its findings, and its reasons for such findings, in a manner it deems fit." |
||
4. (1) These regulations shall come into effect on the 1st day of October, 2015 in relation to all matters notified, reported or otherwise in anyway brought to the attention of the Control Committee on or after that date (including all matters referred to in article 6(1) of the Greyhound Industry (Control Committee and Control Appeal Committee) Regulations, 2007). |
||
(2) Any proceedings in being before either the Control Committee or the Control Appeal Committee on the date on which this Regulation comes into effect shall be continued and determined as if Article 3 of this Regulation had not taken effect. |

The effect of these regulations is to amend the Greyhound Industry (Control Committee and Control Appeal Committee) Regulations, 2007 so as to require the Control Committee and the Control Appeal Committee, when they make a decision in relation to a matter before them under the Regulations, to publish their findings and their reasons for such findings in relation to the decision. |
