I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by subsections (1)(a) and (10)(a) of section 28A (inserted by section 16 of the Health (Miscellaneous Provisions) Act 2014 (No. 33 of 2014)) and section 95 (1)(a) of the Health and Social Care Professionals Act 2005 (No. 27 of 2005) (as adapted by the Health and Children (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 219 of 2011 )), hereby make the following regulations: | ||
1. (1) These Regulations may be cited as the Health and Social Care Professionals Act 2005 (Section 28A) (Optical Registration Board) Regulations 2017. | ||
(2) These Regulations shall come into operation on 31 October 2017. | ||
2. In these Regulations “section 28A” means section 28A (inserted by section 16 of the Health (Miscellaneous Provisions) Act 2014 (No. 33 of 2014)) of the Health and Social Care Professionals Act 2005 (No. 27 of 2005). | ||
3. For the purposes of appointments under subparagraph (i) of section 28A(1)(a) to the Optical Registration Board— | ||
(a) the designated professions of optometrist and dispensing optician are prescribed, | ||
(b) one is prescribed as the number of persons who may be appointed from the designated profession of optometrist, and | ||
(c) two is prescribed as the number of persons who may be appointed from the designated profession of dispensing optician. | ||
4. For the purposes of appointments under subparagraph (ii) of section 28A(1)(a) to the Optical Registration Board— | ||
(a) the designated profession of optometrist is prescribed, and | ||
(b) two is prescribed as the number of persons who may be appointed from the designated profession of optometrist. | ||
5. For the purposes of appointments under subparagraph (iii) of section 28A(1)(a) to the Optical Registration Board— | ||
(a) the designated profession of optometrist is prescribed, and | ||
(b) one is prescribed as the number of persons who may be appointed from the designated profession of optometrist. | ||

These regulations prescribe the number of persons from the designated profession of optometrist and from the designated profession of dispensing optician to be appointed to the Optical Registration Board on their election by the registrants of their profession under the Health and Social Care Professionals Act 2005 . |
