I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving effect to Commission Directive (EU) 2016/1855 of 19 October 20161 hereby make the following regulations: | ||
1. (1) These Regulations may be cited as the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) (Amendment) Regulations 2018. | ||
(2) The Principal Regulations, the Regulations of 2011 and these Regulations may be cited together as the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) Regulations 2010 to 2018. | ||
2. In these Regulations— | ||
“Principal Regulations” means the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) Regulations 2010 ( S.I. No. 119 of 2010 ). | ||
“Regulations of 2011” means the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) (Amendment) Regulations 2011 ( S.I. No. 129 of 2011 ). | ||
3. Regulation 2(1) of the Principal Regulations (as last amended by Regulation 3 of the Regulations of 2011) is amended by substituting for the definition of “Directive” the following definition: | ||
“ ‘Directive’ means Directive 2009/32/EC of the European Parliament and of the Council of 23 April 20092 as amended by Commission Directive 2010/59/EU of 26 August 20103 and Commission Directive (EU) 2016/1855 of 19 October 20161;”. | ||

EXPLANATORY NOTE | ||

These Regulations give effect to Commission Directive (EU) 2016/1855 of 19 October 2016 amending Directive 2009/32/EC of the European Parliament and of the Council on the approximation of the laws of the Member States on extraction solvents used in the production of foodstuffs and food ingredients. | ||
Part II of the Annex to Directive 2009/32/EC lists the extraction solvents for which conditions of use are specified with details of “name”, “conditions of use” and “maximum residue limits in the extracted foodstuff or food ingredient” set out in table format. “Dimethyl ether” was added to that list by Commission Directive 2010/59/EU of 26 August 2010 and its “conditions of use” and “maximum residue limits in the extracted foodstuff or food ingredient” were specified. Commission Directive (EU) 2016/1855 amends the “conditions of use” and “maximum residue limits in the extracted foodstuff or food ingredient” of Dimethyl ether. | ||
These Regulations amend the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) Regulations 2010 ( S.I. No. 119 of 2010 ) in the manner specified in these Regulations. | ||
These Regulations may be cited as the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) (Amendment) Regulations 2018. | ||
