Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 19th July, 2019.

I RICHARD BRUTON, Minister for Communications, Climate Action and Environment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2002/58/EC of the European Parliament and of the Council of 12 July 20021 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) (Amendment) Regulations 2019.

2. Regulation 2 of the European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) Regulations 2011 ( S.I. No. 336 of 2011 ) is amended by the substitution of the following definition for the definition of “operator”:

“ ‘operator’ means a person required by the Regulator under Regulation 19(4) of the Universal Service Regulations to keep the National Directory Database within the meaning of that Regulation;”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These regulations amend the European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) Regulations 2011 ( S.I. No. 336 of 2011 ) by substituting the meaning of the term “operator” to align the term in those Regulations with the undertaking required to keep the record of all subscribers of publicly available telephone services, known as the National Directory Database, under the European Communities (Electronic Communications Networks and Services) (Universal Service and Users’ Rights) Regulations 2011 (S.I. No. 337/2011).
