I, HEATHER HUMPHREYS, Minister for Social Protection, in exercise of the powers conferred on me by sections 4 (as adapted by the Employment Affairs and Social Protection (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 447 of 2020 )) and 138 (amended by section 9 of the Social Welfare Act 2016 (No. 15 of 2016)) of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), hereby make the following Regulations: | ||
Citation and construction | ||
1. (1) These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 7) (Treatment Benefit) Regulations 2021. | ||
(2) These Regulations and the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2021 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2021. | ||
Commencement | ||
2. These Regulations shall have effect from 27 March 2021. | ||
Amount payable in respect of medical appliance benefit | ||
3. The Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ) is amended by the substitution of the following article for article 110: | ||
“110. The payment to be made by the Minister in respect of medical appliance benefit under this article and article 111 shall be the cost of providing or repairing an appliance, subject to a maximum payment as may from time to time be fixed by the Minister, and the remainder of the said cost, if any, shall be paid by the claimant.”. | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||
These Regulations remove the requirement for the customer to pay 50% of the cost of medical appliance benefit, effective from 27 March 2021, arising from Budget 2021. | ||
At the time of signature the maximum hearing aid grant is €500 per hearing aid and the maximum repair grant is €100. If the cost exceeds the maximum grant the remainder shall be paid by the customer. |
