Notice of the making of this Statutory Instrument was published in | ||

I, FRANK FEIGHAN, Minister of State at the Department of Health, in exercise of the powers conferred on me by sections 2 and 15 of the Public Health (Sunbeds) Act 2014 (No. 12 of 2014) and the Health (Delegation of Ministerial Functions) (No. 3) Order 2020 ( S.I. No. 599 of 2020 ), hereby make the following regulations: | ||
1. (1) These Regulations may be cited as the Public Health (Sunbeds) (Health Information) (Amendment) Regulations 2022. | ||
(2) The Principal Regulations, the Regulations of 2015 and these Regulations may be cited together as the Public Health (Sunbeds) (Health Information) Regulations 2015 to 2022. | ||
2. In these Regulations— | ||
“Principal Regulations” means the Public Health (Sunbeds) (Health Information) Regulations 2015 ( S.I. No. 50 of 2015 ); | ||
“Regulations of 2015” means the Public Health (Sunbeds) (Health Information) (Amendment) Regulations 2015 ( S.I. No. 168 of 2015 ). | ||
3. Regulation 5 of the Principal Regulations (as amended by Regulation 3 of the Regulations of 2015) is amended— | ||
(a) by substituting for paragraph (2) the following: | ||
“(2) The form prescribed in paragraph (1) shall contain the text set out in Schedule 2 and shall— | ||
(a) be printed in black indelible ink on white paper or white cardboard, or | ||
(b) be displayed on a screen in black text on a white background, in a form which allows for electronic signature, | ||
in verdana typeface and a font size of at least 14.”, and | ||
(b) by substituting for paragraph (4) the following: | ||
“(4) The form prescribed in paragraph (3) shall contain the text set out in Schedule 3 and shall— | ||
(a) be printed in black indelible ink on white paper or white cardboard, or | ||
(b) be displayed on a screen in black text on a white background, in a form which allows for electronic signature or mark by the person proposing to use, hire or purchase a sunbed, and which allows for electronic signature by the owner, manager or employee of the sunbed business, | ||
in verdana typeface and a font size of at least 14.”. | ||

These Regulations amend the Public Health (Sunbeds) (Health Information) Regulations 2015 ( S.I. No. 50 of 2015 ), as amended by the Public Health (Sunbeds) (Health Information) (Amendment) Regulations 2015 ( S.I. No. 168 of 2015 ), to allow for persons using, hiring or purchasing sunbeds to confirm by electronic means that they have been provided with a copy of the prescribed information and have had an opportunity to read and consider same. | ||
These Regulations may be cited as the Public Health (Sunbeds) (Health Information) (Amendment) Regulations 2022. |
