I, HELEN MCENTEE, Minister for Justice, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Directive 2012/13/EU of the European Parliament and of the Council of 22 May 20121 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Union (Right to Information in Criminal Proceedings) Regulations 2022. | ||
2. A summons issued under section 11 (2) of the Petty Sessions (Ireland) Act 1851 (14 & 15 Vict., c.93) or section 1 of the Courts (No. 3) Act 1986 (No. 33 of 1986) and served upon the person to whom it is directed shall be accompanied by the following written information on the procedural rights of the person: | ||
(a) his or her right of access to a solicitor; | ||
(b) his or her entitlement to free legal advice and the conditions for obtaining such advice; | ||
(c) his or her right to interpretation and translation. | ||
