(Samedi Division)

5th November 2001

Before:

Sir Philip Bailhache, Bailiff, and Jurats Potter and Le Breton.

Between

Mary Bridget Cooper (née Mulhall)

  Plaintiff

And

Alan Cooper

  Defendant

The ninth Representation of the Plaintiff alleging breach of a non-molestation injunction.

Advocate N.L.M. Langlois the Plaintiff.

The Defendant on his own behalf.

judgment

the bailiff:

1.        We are satisfied beyond reasonable doubt that there has been a breach of the injunctions imposed by the Court when Mr. Cooper went on two occasions, which have been specified in the ninth Representation, to the premises of the Plaintiff in the middle of the night, contrary to the order of the Court.

2.        Mr. Cooper, this was a serious contempt of the Court's order and you must understand that the Court will not tolerate this behaviour.  We are going to send you to prison, but we are going to ask the Court welfare officer to see what can be done to advise you while you are in prison and to help you with the different grievances which you have explained in to the Court this morning.  In the meantime, we are going to punish you for your disobedience of  the Court order and you are sentenced to three months' imprisonment.  We re-impose the power of arrest for six months with effect from today.
