    THE INDUSTRIAL TRIBUNALS

    CASE REF: 1121/06

    CLAIMANT: Tanya Roberta Kirkpatrick

    RESPONDENT: 1. Robert Ferguson

    2. Warehouse Direct
    3. Warehouse Direct Discount Stores Ltd

    DECISION

The unanimous decision of the tribunal is that the claimant's claim is dismissed.

    Constitution of Tribunal:

    Chairman: Ms J Knight

    Members: Mrs M Mulligan

    Mrs M Gregg

    Appearances:

The claimant did not appear and was not represented.

None of the respondents appeared nor were represented and in any event did not have the right to resist the claim because none had entered responses.

  1. The issue to be determined by the Tribunal was whether the claimant was unfairly dismissed.
  2. The tribunal decided to dispose of the proceedings in the absence of the parties as it was satisfied all the parties were notified of date for hearing and no communication had been sent to the Office of the Tribunals to request a postponement or otherwise to explain their non attendance.
  3. The Tribunal considered all the information in its possession made available to it by the parties. The tribunal considered that although the onus is on an employer to show the reason for the dismissal, in this case there was insufficient information from the claimant upon which it could make a finding that she had been unfairly dismissed. Therefore the tribunal dismisses the proceedings.
  4. Chairman:

Date and place of hearing: 21 November 2007, Belfast

Date decision recorded in register and issued to parties:
