The decision of the tribunal is that the claimant’s claims in respect of breach of contract and unauthorised deductions from his wages be dismissed.
Constitution of Tribunal:
Chairman (Sitting Alone): Ms Bell
1. (i) The claimant did not attend the hearing and no communication was received from him.
(ii) Notice of Hearing was sent to the claimant on 30 July 2008. The tribunal was satisfied that it should dispose of the case in the absence of the claimant. Before doing so, it considered the claim form submitted by the claimant and heard submissions from Mr Sheridan.
2. The tribunal is satisfied on the basis of submissions made on behalf of the respondent and in the absence of evidence from the claimant that the claimant was on 1 August 2008 paid all monies to which he was entitled.
3. The tribunal therefore dismisses the claimant’s claim.
