THE INDUSTRIAL TRIBUNALS
CASE REF: 1471/11
CLAIMANT: Sarah Carter
RESPONDENTS: Ronnie McCormack and N Bayes
T/A Landscape Interiors
DECISION
The decision of the tribunal is that the claimant is entitled to redundancy payment in the sum of £3,600.00 and notice pay in the sum of £545.91.
Constitution of Tribunal:
Chairman (sitting alone): Mr P Kinney
Appearances:
The claimant appeared in person and represented herself.
The respondents did not appear and were not represented.
1. Before the hearing commenced the tribunal received an e-mail from Mr McCormack seeking a postponement of the hearing today in order to facilitate mediation in this matter. I do not consider that the reason for the postponement put forward by Mr McCormack is sufficient to justify adjourning proceedings today. I have therefore determined to proceed with the hearing.
FACTS
2. The claimant was employed by the respondents until her employment ended on 29 April 2011. The claimant’s age at the date of termination was 54 and she had eight years’ continuous service. Her gross weekly wage was £300.00 and her net weekly was £249.47. The claimant was dismissed due to the economic downturn. She received five weeks’ notice. She received Jobseeker’s Allowance from 30 April 2011 in the sum of £67.50 per week.
3. I am satisfied that the claimant’s claims are well-founded. The claimant is entitled to a redundancy payment in the sum of £3,600.00. The claimant is also entitled to three weeks’ notice pay based on her net week, less any other income received in that period. The claimant is entitled £545.91.
4. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
