THE INDUSTRIAL TRIBUNALS
CASE REF: 279/12
CLAIMANT: Nigel David Broome
RESPONDENT: Paul Phillips
DECISION
The decision of the tribunal is that the respondent do pay to the claimant the sum of £437.50 in respect of unpaid holiday pay.
Constitution of Tribunal:
Chairman (sitting alone): Mr D Buchanan
Appearances:
The claimant appeared in person and was not represented.
The respondent did not enter a response, nor did he appear at the hearing.
1. The second-named respondent, Ashleigh Phillips, is dismissed from the proceedings. The claimant accepts that Ms Phillips was not his employer.
2(1) I am satisfied from the uncontradicted evidence of the claimant that he is entitled to the sum of £473.50 in respect of unpaid holiday pay. A letter from the claimant to the respondent seeking payment went unanswered.
(ii) I order that the respondent do pay to the claimant the said sum of £473.50.
3. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
