DECISION

 

 

(A)      The claimant’s wages claim is well-founded and it is ordered that the respondent shall pay to the claimant the sum of £ 1,028 in respect of wages.

 

(B)      The claimant’s holiday pay claim is well-founded and it is ordered that the respondent shall pay to the claimant the sum of £ 980 in respect of holiday pay.

 

(C)     The claimant’s claim for notice pay is well-founded and it is ordered that the respondent shall pay to the claimant the sum of £ 2,891 in respect of notice pay.

 

(D)     The claimant’s redundancy pay claim against the respondent is well-founded and it is declared that the respondent is liable to make a redundancy payment of £ 3,290 to the claimant.

REASONS

 

  1. I announced my decision at the end of the hearing.  At the same time, I gave brief oral reasons for that decision.

 

2.     I am satisfied that it was not reasonably practicable for the claimant to present her wages, holiday pay and notice pay claims within the relevant primary time-limit and that those claims were presented within a further period which I consider to be reasonable.

 

  1. The redundancy pay decision is based on the following information:

 

Gross weekly pay: £ 470 (deemed)

 

Number of actual completed years of service: 7

 

Age on date of dismissal: 39

 

Multiplier (for redundancy pay): 7

 

4.     The claimant was granted leave to amend her claim form so as to include a redundancy pay claim.

 

  1. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
