THE INDUSTRIAL TRIBUNALS

CASE REF:  4057/19

CLAIMANT:                          Amy (Frances) Baxter

RESPONDENT:                  The Postcard Company Ltd

DECISION

The claimant’s redundancy claim against the respondent is well-founded and the respondent is liable to make a redundancy payment of £3,953.04.

REASONS

1.            Rule 28 of Schedule 1 of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005 provides:

“If the parties agree in writing upon the terms of any order or decision, a chairman or tribunal may, if he or it thinks fit, make such Order or decision.”

2.            The parties have requested in writing and by consent a decision pursuant to the above rule and have agreed the amount of £3,953.04  is due and owing by way of a redundancy payment under the Employment Rights (NI) Order 1996 (as amended), accordingly the respondent is liable to make a redundancy payment of £3,953.04  to the claimant.

3.         This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
