2.(1) The functions of the Trust shall be exercisable for the benefit (whether direct or indirect) of agricultural producers in Northern Ireland and shall be (a)to supplement the activities of the Ministry of Agriculture (in this Act referred to as "the Ministry") and of other persons (including agricultural marketing boards and other organizations) in securing, and to encourage and assist other persons to secure, improvements in, and the development and expansion of, agricultural production, and the processing and marketing of agricultural produce; (b)to devise methods of securing, and to consider, promote, assist or undertake projects intended to secure, improvements in, or the development or expansion of, agricultural production, or the producing, processing or marketing of agricultural produce; and (c)to collect and record such information as they may deem necessary to enable them to determine whether any such method ought to be devised or project ought to be considered, promoted, assisted or undertaken by the Trust. (2) Subject to the provisions of this Act, the Trust shall have power to carry on any activity the carrying on of which is reasonably necessary, advantageous or convenient for or in connection with the exercise of all or any of the functions mentioned in subsection (1) and, in particular may in the discharge of those functions (a)carry out, or arrange for the carrying out of, any economic or other survey, investigation, examination, experiment, research, or test and disseminate, or arrange for the dissemination of, the conclusions or results thereof; (b)either alone or in conjunction with other persons (including the Ministry) assist, financially or otherwise, persons devising or developing new crops or varieties of crop or strains of livestock or methods of producing, processing or marketing agricultural produce; (c)either alone or in conjunction with other persons (including the Ministry) provide, or make arrangements for the provision of, or give financial assistance towards the provision of, services and facilities designed to secure improvements in, and the development and expansion of, agricultural production and the processing and marketing of agricultural produce; (d)either alone or in conjunction with other persons engage in any trade or business the carrying on of which is considered by the Trust to be advantageous or convenient for or in connection with the exercise of all or any of the functions of the Trust, including the producing, manufacturing, processing, or selling any produce or any plant, machinery, apparatus, appliance, substance, liquid, animal or thing, erecting buildings, operating hire purchase schemes, lending money, establishing and operating shops and showrooms and promoting or aiding in the promotion of displays, exhibitions and demonstrations and may close down or dispose of any trade or business carried on by or on behalf of the Trust. But nothing in this paragraph shall operate to authorise the Trust to engage in a trade or business having as its main object, or as one of its main objects, the supplying of goods required by agricultural producers; (e)form, or arrange or encourage the formation of, public or private companies under the Companies Act (Northern Ireland) 1960 or co-operatives or partnerships having amongst their principal objects that of carrying on any activity necessary, advantageous or convenient for or in connection with the exercise of all or any of the functions of the Trust and appoint members of the Trust or other persons to act as directors of any such company or to represent the Trust in any such co-operative or partnership; (f)assist (either financially or otherwise) in the establishment and operation of groups of agricultural producers or of agricultural co-operatives where the Trust is satisfied that the main object of the organization assisted is the securing of benefits for the agricultural industry as opposed to the supplying of goods required by agricultural producers; (g)borrow or raise money in the manner authorised by this Act; (h)invest money standing to the credit of the Trust in any investment for the time being authorised by law for the investment of trust property, and sections 1, 2, 5, 6, 12 and 13 of the Trustee Investments Act 1961 (investment powers of trustees), as applied in Northern Ireland by the Trustee Acts (Northern Ireland) 1958 and 1962 shall apply in relation to the power of investment conferred by this paragraph as if the Trust were trustees and money standing to the credit of the Trust were trust property; (i)manage, improve, work or otherwise deal with any land or other property for the time being held or acquired by the Trust and hold and act as trustee of any land or other property held for any agricultural purpose; (j)pay to persons holding office as chairman or other member of the Trust or who (not being a member or officer or servant of the Trust) serve on a committee constituted by the Trust or as a director or representative appointed by the Trust, such remuneration, if any, in respect of that office, service or appointment and such allowances (including allowances in respect of loss of remunerative time) in respect of expenses properly incurred in connection therewith as the Ministry with the approval of the Ministry of Finance may determine; (k)without prejudice to any other powers exercisable by them, make and carry into effect such arrangements with other persons as appear to the Trust to be necessary or desirable for the exercise and performance of any function conferred on them by or under this Act; or (l)receive grants, donations, gifts and legacies for the furtherance of any of the objects of the Trust.
