3.(1) The Trust shall not without the prior approval in writing of the Ministry undertake, or arrange for the undertaking of, any activity in a financial year, if the cost likely to be incurred in that year in connection with that activity is expected to exceed #2,000 or such other sum as the Ministry may, in the case of any activity or class of activities, specially direct; but, in estimating for the purposes of this subsection the cost likely to be incurred in connection with an activity, remuneration, allowances and expenses payable to members of, or persons in the full-time employment of, the Trust shall not be taken into account. (2) The Trust may, with the consent or upon the direction of the Ministry (a)dispose of the whole or part of any undertaking being carried on by the Trust if the Ministry is satisfied that the undertaking or the part thereof proposed to be disposed of has become capable of being operated by other persons at a fair profit; and (b)discontinue any activity being carried on by the Trust if the Ministry is satisfied that the activity has been unsuccessful in its results or has achieved its object; (3) Any property or assets disposed of by the Trust whether in consequence of a direction given under subsection (2) or otherwise shall not be disposed of except upon terms approved by the Ministry. (4) The right of the Trust under section 19(1)(a)(vi) of the Interpretation Act (Northern Ireland) 1954 to employ staff shall be exercised subject to any directions which may be given by the Minister with respect to the numbers and terms and conditions of service of persons employed or to be employed by the Trust and shall not be exercised with respect to the principal officer of the Trust, or such other senior officers of the Trust as the Ministry may specify, except with the prior approval of the Minister. (5) In giving financial or other assistance to any other organization or person the Trust shall have regard to the extent to which any such assistance may be available to that organization or person from any other source. (6) For the avoidance of doubt it is hereby declared that the provisions of section 2(2) with respect to the powers of the Trust relate only to their capacity as a body corporate and are not intended to authorise the disregard of any enactment or rule of law.
