Restriction on use of certain descriptions. 19.(1) It shall not be lawful for the proprietor of any catering establishment or other premises to describe or hold out or permit any person to describe or hold out such premises as an hotel unless such premises are registered in the register of hotels and such proprietor is registered in that register as the registered proprietor of such premises. (2) It shall not be lawful for the proprietor of any catering establishment or other premises to describe or hold out or permit any person to describe or hold out such premises as a guest house unless such premises are registered in the register of guest houses and such proprietor is registered in that register as the registered proprietor of such premises. (3) It shall not be lawful for the proprietor of any catering establishment or other premises to describe such premises as a boarding house... or to hold out such premises as a boarding house... or to permit any person to so describe or so hold out such premises unless such premises are registered in the register of boarding houses... and such proprietor is registered in that register as the registered proprietor of such premises. (4) It shall not be lawful for the proprietor of any catering establishment or other premises to describe or hold out or permit any person to describe or hold out such premises as a restaurant unless such premises are registered in the register of restaurants and such proprietor is registered in that register as the registered proprietor of such premises. (5) Any person who acts in contravention of any of the provisions of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds together with a further fine not exceeding one pound for every day during which the offence continues after such conviction: Provided that any proprietor of premises used as a catering establishment who has appealed to the county court in accordance with the provisions of sub-section (2) of section fourteen of this Act shall not be liable to be prosecuted for an offence under this section which is alleged to have been committed in respect of those premises during the period between the lodgment of the notice of such appeal in the county court and the determination thereof by that court.
