Provision of amenities and services by local authorities. 26.(1) A local authority may in accordance with a scheme approved by the [Ministry] themselves provide or assist either financially or otherwise any other person or body in the provision of any [tourist amenity]. (2) A scheme approved under this section may provide for the acquisition (whether by agreement or compulsorily...), holding or disposal of land by a local authority for the purposes of the scheme. (3) A scheme approved under this section may provide for the making of charges (including ticket or admission fees, rents or other sums) by the local authority or any other person or body in respect of the [tourist amenity] provided thereunder or in connection therewith and for the payment of any revenue derived therefrom to the credit of, and for debiting any losses incurred thereunder or in connection therewith to such fund or funds as may be specified in the scheme. (4) The powers conferred on the local authority under or by virtue of this section shall be exercisable notwithstanding any prohibition or restriction contained in any enactment passed before the commencement of this Act. (5) A scheme approved under this section may be varied or modified by a subsequent scheme so approved. S.27 rep. by 1972 c.9 (NI) s.149(2) sch.9
