Disposal of non pecuniary forfeitures. 69.(1) Without prejudice to the provisions of any other enactment, any person who attempts to commit, or incites, ..., another person to commit, any summary offence shall be guilty of an offence punishable on summary conviction and shall be liable to be proceeded against, convicted and punished as if he had committed the summary offence. (2) Where a person is charged before a magistrates' court with a summary offence, and it appears to the court that the person charged did not commit the offence charged but that he was guilty of attempting to commit that offence, the court may convict him of attempting to commit that offence and may punish him in the same manner as if he had been charged with attempting to commit that offence.
