PROTECTION OF THE PERSON AND PROPERTY ACT (NORTHERN IRELAND) 1969 PROTECTION OF THE PERSON AND PROPERTY ACT (NORTHERN IRELAND) 1969 - LONG TITLE An Act to protect the person and property by penalising certain acts of intimidation and the making or possession or use of certain devices containing an inflammable liquid or substance; to provide for the summary trial of certain offences under the Malicious Damage Act 1861; and for related purposes. [3rd December 1969] Intimidation. PROTECTION OF THE PERSON AND PROPERTY ACT (NORTHERN IRELAND) 1969 - SECT 1 1. A person shall be guilty of an offence under this section if he unlawfully causes, by force, threats or menaces, or in any way whatsoever, any other person (a)to leave any place where that other person is for the time being resident or in occupation; or (b)to leave his employment; or (c)to terminate the service or employment of any person; or (d)to do or refrain from doing any act. PROTECTION OF THE PERSON AND PROPERTY ACT (NORTHERN IRELAND) 1969 - SECT 2 Making or possessing petrol bombs, etc. 2. Any person who makes, or has in his possession, any apparatus, instrument, article or thing which (a)contains any inflammable liquid or substance; or (b)is constructed or adapted for use in conjunction with any such liquid or substance so as to cause injury or loss of life to any person or damage to any property; Use of petrol bombs, etc. PROTECTION OF THE PERSON AND PROPERTY ACT (NORTHERN IRELAND) 1969 - SECT 3 3. Any person who, with intent to cause the destruction of or damage to property of another or in which another has an interest, or to cause personal injury to another, or to give another reasonable cause to fear any destruction of property or personal injury, or, being reckless in regard to causing any such destruction, damage, injury or fear, throws, places, attaches or otherwise makes use of any such apparatus, instrument, article or thing as is mentioned in section 2 shall be guilty of an offence under this section. PROTECTION OF THE PERSON AND PROPERTY ACT (NORTHERN IRELAND) 1969 - SECT 4 Penalties. 4.(1) A person guilty of an offence under section 1 or 2 shall be liable (a)on summary conviction to a fine not exceeding #500 or to imprisonment for a term not exceeding two years or to both such fine and such imprisonment; (b)on conviction on indictment to a fine of such amount as the court may think proper or to imprisonment for a term not exceeding five years or to both such fine and such imprisonment. (2) A person guilty of an offence under section 3 shall be liable on conviction on indictment to a fine of such amount as the court may think proper or to imprisonment for a term not exceeding ten years or to both such imprisonment and such fine. S.5 rep. by 1977 NI 4 art.13(6) sch.2 PROTECTION OF THE PERSON AND PROPERTY ACT (NORTHERN IRELAND) 1969 - SECT 6 Procedure for certain offences. 6.(1) Section 41 of the Magistrates' Courts Act (Northern Ireland) 1964 (right to claim trial by jury for certain summary offences) shall not apply to (a)an offence under section 1 or section 2; or Para.(b) rep. by 1977 NI 4 art.13(6) sch.2 Subs.(2) rep. by 1977 NI 4 art.13(6) sch.2 PROTECTION OF THE PERSON AND PROPERTY ACT (NORTHERN IRELAND) 1969 - SECT 7 Short title. 7. This Act may be cited as the Protection of the Person and Property Act (Northern Ireland) 1969.
