Holidays with pay. 20.(1) Every person employed in or about the business of a shop shall, subject to the provisions of this section, be entitled to holidays of at least one week's duration in respect of his employment for any period of twelve months (and so in proportion for any lesser period of employment) and shall in respect of the period of any such holidays receive from his employer wages at a rate which is not less than the rate of wages to which he was entitled immediately before such holidays. (2) The holidays to which any person is entitled under the preceding sub-section shall be in addition to any half-holidays or holidays to which he may be entitled under any other provision of this Part of this Act or under any other enactment. (3) Any agreement for the payment of holiday pay otherwise than in accordance with the provisions of this section made by or with any person employed in or about the business of a shop shall be void. (4) Any sum due to any person by virtue of this section may irrespective of its amount be recovered summarily as a civil debt notwithstanding the fact that proceedings for recovery of any penalty have been or may be instituted in respect of any failure to make such payment. (5) In the case of any contravention of the provisions of this section the occupier of the shop in respect of which the contravention occurred shall, without prejudice to any civil liability, be liable to a fine not exceeding twenty pounds for every person in respect of whom the contravention occurs, and, in case any contravention of the provisions of this section has in fact been committed by some agent of the occupier, that agent shall be liable to be proceeded against for such contravention in the same manner as if he were the occupier, and either together with, or before or after the conviction of, the occupier, and shall be liable on conviction to the same punishment as that to which the occupier is liable. (6) This section shall not apply in the case of a person employed in or about the business of a shop who is, either before or after the commencement of this Act, allowed holidays with pay under or by virtue of the Wages Councils Act (Northern Ireland), 1945, or who is before the commencement of this Act allowed holidays with pay under or by virtue of any enactment repealed by the said Wages Councils Act (Northern Ireland), 1945.
